  <title><![CDATA[Contract Assembly the Easy (and free) Way]]></title>
  <description><![CDATA[I spoke with Jason Mark Anderman, President and co-founder of WhichDraft.com, a completely free automated contract assembly service, who advises members of the legal community that this is the greatest time to possibly start a business because there are a lot of services that you can offer in a down economy that save people money (e.g., drafting contracts for free).

He notes that hopeful software architects need to take responsibility for determining what their product/service should look like themselves.   <description><![CDATA[A few weeks ago, the Total Practice Management Association sponsored the Get a Life conference, which it describes as an event to help attorneys "manage all the moving parts of a successful law practice and still have a life."  I spoke with Kevin Chern, the President of Total Attorneys, Inc., which founded of the Total Practice Management Association and served as the principal sponsor of the conference.  There were purportedly 250 live attendees and over 2,100 unique log-ins to its real-time web stream.

Kevin highlighted:

-By doing things smarter, you can work less and be more successful, e.g., instead of managing staff, hire virtual assistants.
-There is a misconception that you have to start working at 9am and leave the office at 5 or 6pm.  By having balance, there does not need to be a strict demarcation between your personal and professional life.

His ultimate message:  You can have a better quality of life and be more successful while working more reasonable hours.]]></description>

  <description><![CDATA[I spoke with Kevin Werbach, a lawyer and professor of legal studies at the Wharton School of the University of Pennsylvania, where he focuses his research on Internet and telecommunications policy. Werbach served as a co-lead on the FCC review of the Obama Administration's Presidential Transition Team. He also founded the Supernova conference, which he describes as an "executive forum for the digital age." 

We discussed the new legal track at this year's conference (December 1st through the 3rd in San Francisco), including coverage of trademarks and intermediaries, privacy and the social web, and reforming copyright law, among others, as well as his goals for lawyers who attend.

  <title><![CDATA[Google Scholar and the Legal Research Landscape]]></title>
  <description><![CDATA[I spoke with Rick Klau, the product manager on Blogger for Google, who was a contributor to the team that recently launched case law on Google Scholar.  We discussed his work at Blogger, the purpose of the case law project, and its impact on the legal research landscape.  He noted:

"There is a wealth of information at [your] fingertips now through a browser."

"This is something that is good for citizens.  It is good for general transparency."

With respect to what is next for Google in this area, he noted "Personally, I would like to see more information made available on the Internet."  Also, "This is an important first step."

"I would hope that we would be able to get more information and hopefully expand it; there are other common law countries."]]></description>

Some of the findings included:

-Approximately 40% of companies are hindered by a lack of in-house expertise and an unclear information strategy.
-Workflow transformation, records management and e-discovery/compliance are areas in which companies are expected to invest in the next two years.
-Nearly half of the survey respondents were unfamiliar with the EDRM.]]></description>

  <title><![CDATA[Has the Economy Stabilized?]]></title>
  <description><![CDATA[I spoke with Mike Kohlsdorf, CEO of Aderant, an application software company that focuses on professional services firms, about the changes in the economy and an increased need for technology solutions at law firms.  We discussed criteria that law firms use to evaluate technology, i.e., quality,  implementation speed and customer support.  He highlighted that great products are architecturally open, scalable, feature rich functionality and have a low total cost of ownership. 

He also offered his predictions for the remainder of the year, noting "We are starting to approach, at least in the legal vertical, some level of stability."  He referenced Citi Private Bank's Managing Partner Confidence Index, which reports, according to this article in The Recorder, "About two-thirds of 133 managing partners or chairmen surveyed said the economy is the same or better than six months ago, and 59 percent expect a stable or improving economy over the next six months."

In fact, "there is a lot more optimism today than there was as little as two or three months ago," Kohlsdorf said.]]></description>

  <description><![CDATA[Earlier this week, I attended an invitation-only breakfast hosted by David Cowen, the managing director of The Cowen Group, an executive search and market analysis firm focusing exclusively on litigation support and e-discovery.  The event featured an esteemed panel of thought leaders in e-discovery sharing insider accounts of the early case assessment trend and strategies for conducting one successfully.  The attendees and panelists hailed from corporate America, the AmLaw 200 and vendors, including Anacomp, Capital Legal Solutions, DataCert and Recommind, who co-sponsored the program.
Cowen and I discussed hiring trends and the market for legal talent. While he is observing a flattening of the employment market in law firms, and possibly a depression, following years of double-digit growth, he is seeing an upward demand for staff on the corporate side.  His group, for example, has 12 openings for major corporations looking for in-house e-discovery talent.  Cowen highlights that the moment an organization makes the decision to insource, they realize they need the talent to drive that strategy and will likely get it from law firms and vendors.

He views the corporate market as similar to the positioning of major law firms in 2003-2005, who were just establishing major e-discovery practices.  As such, he has a optimistic view of the employment picture.]]></description>

  <title><![CDATA[Setting Limits on E-Discovery in 2010]]></title>
  <description><![CDATA[I spoke with Robert Owen, a partner with Fulbright & Jaworski L.L.P. He is head of the New York location's litigation group, as well as co-head of the firm's E-Discovery and Information Management practice group.  Owen is part of the core team that conceived of and has administered Fulbright's Annual Litigation Trends Survey since its inception in 2004.

We discussed his his New York Law Journal article, Seeking Ways to Set Limits on E-Discovery, in which he cites the factors that are leading numerous groups to initiate re-examinations of U.S. e-discovery rules, summarizes their progress and makes predictions for 2010.  He noted that "we are alone among the nations of the world in having adopted a full pre-trial disclosure philosophy back in 1938" and "what we are seeing now is a confluence of efforts" by diverse groups to make litigation more manageable.]]></description>
